The following terms and conditions apply to all purchase contracts between commercial buyers and Apparel Express GmbH.

By using and ordering from this website you agree to be bound by these terms and conditions.

Apparel Express may change these Terms & Conditions of Sale without prior notice, so you should review these conditions from time to time.

§ 2  Registration

We deal with trade customers only and do not sell to consumers. To be able to see our prices and make orders clients have to be registred. For a user's first order we will ask the user supply billing and shipping address information. 

§ 3  Ordering

All orders placed by you are subject to acceptance by www.apparelexpress.eu and apparelexpressi.us

Apparel Express GmbH reserves the right to revise prices, limit quantities, correct errors in its cataloge and refuse orders at its discretion.

Bulk orders may be composed of a minimum number of products or order value.

The minimum quantity of products in the order can be determined.

Discount is calculated based on the number of purchases.

Orders may be canceled or refused if goods are out of stock or if payment authorisation cannot be obtained.

§ 4  Drop shipping program

We offer dropship service that allows you to sell our product on your online stores.

We will deliver orders directly to your customer. All you need is to place an order with your customer's name and shipping address.

There is no minimum order amount requirement for dropship service.

To get access to our dropship service, you have to become a member of our dropship program.

We do not charge any fee for membership.

§ 5  Pricing and VAT

All prices on the website are in Euro and not VAT included.

EU customers are VAT - registered provided valid EU VAT number may not be charged VAT depending on the shipping destination. 

§ 6 Payment

Goods will not be dispatched until full and cleared payment is received.

You must pay for the products at the time you place your order.

We accept payment via credit and debit cards, PayPal and bank transfers. It is important that your payment reaches us swiftly to ensure you receive all the items on your order. Please be aware that we may need to conduct further checks to confirm your identity as a fraud preventative measure.

If you choose to pay via "PayPal", you bear the costs yourself.

§ 7 Delivery

We will dispatch the order usually on the day after the order has been placed.

We are closed during weekends and bank holidays. If you place an order on the weekend, it will be dispatched on the next business day.

§ 8 Return and cancelation

Orders may be canceled prior to despatch of goods by email or by telephone. A full refund of payment will be made if already processed.

We will incur all return shipping charges if the goods are faulty, received in an unsatisfactory condition, despatched in error, or misrepresented on our website.

For the dropship customer, the goods can be returned for any reason within 14 days after receipt of the goods. Goods must be returned in a resaleable condition with all packaging intact.

§ 9 Retention of Title

The products will be your responsibility and at your risk from the time of delivery. Title to the goods passes to you on delivery, unless full payment or any other amount payable by you is outstanding at delivery, in which case title is retained by us until you have paid in full the price and all other amounts payable under the contract. You agree that we may still sue for the price, notwithstanding that title has not passed. You also agree that your right to possession and use of the goods shall cease if any amount payable by you under the contract becomes overdue, or you enter into liquidation or administration, and that we shall be entitled to enter any premises where the goods are kept for the purposes of repossessing them.

Risk of damage to or loss of the Goods shall pass to you in the case of Goods to be delivered otherwise than at our premises, at the time of delivery or, if you fail to take delivery of the Goods, the time when we have tendered delivery of the Goods.

Notwithstanding delivery and the passing of risk in the Goods or any other provision of these Conditions, the legal and equitable property in the Goods shall not pass to you until we have received in cleared funds payment in full of the price of the Goods.

Until such time as the property of the Goods passes to you (and provided the Goods are still in existence and have not been resold) we shall be entitled at any time to require you to deliver the Goods to us and, if you fail to do so forthwith, to enter upon any premises where the Goods are stored and repossess the Goods.

§ 10 Place of Jurisdiction

These terms of sale and the supply of the goods will be subject to German law and the German courts will have jurisdiction in respect of any dispute arising from the contract.
